Balham Stay Booking Terms and Conditions

Bookings are made and accepted only on the following terms and conditions.

Balham Stay and www.balhamstay.com ("the Website") are owned and operated by Nicholas Samuel ("the Owner").

1. Contract and Booking

1.1 The contract for the holiday accommodation is between the person making the booking ("the Guest" or "Lead Guest") and Nicholas Samuel ("the Owner").

1.2 This agreement is made on the basis that the Property is occupied solely for holiday, leisure, business travel, temporary accommodation, or other short-term residential purposes.

1.3 The booking creates a licence to occupy for the agreed booking period only and does not create a tenancy or confer any security of tenure rights.

1.4 The Lead Guest must be at least 18 years old.

1.5 Bookings are not confirmed until written confirmation has been issued by the Owner.

1.6 The Lead Guest is responsible for ensuring that all members of the booking party comply with these Terms & Conditions.

2. Deposit

2.1 A non-refundable deposit of £100 is required to secure a booking unless otherwise agreed.

2.2 The balance of the booking is payable in accordance with the payment schedule confirmed at the time of booking.

3. Travel Insurance

3.1 Guests are strongly encouraged to obtain suitable travel and cancellation insurance.

4. Payment

4.1 The full balance must be paid no later than 8 weeks prior to arrival unless otherwise agreed in writing.

4.2 If payment remains outstanding more than 7 days after the due date, the Owner may cancel the booking.

4.3 The Guest remains liable for any loss suffered by the Owner if the cancelled dates cannot be re-let.

5. Owner's Responsibilities

5.1 The Owner will use reasonable endeavours to ensure the Property is available and maintained to a satisfactory standard.

5.2 The Owner shall not be liable for:

  • Loss or theft of personal belongings.

  • Injuries or accidents not resulting from the Owner's negligence.

  • Failure of public utilities.

  • Internet interruptions.

  • Travel disruption.

  • Events outside the Owner's reasonable control.

6. Guest Responsibilities

6.1 Guests shall keep the Property, fixtures, fittings and contents in a clean and tidy condition.

6.2 Any damage, breakages or missing items must be reported immediately.

6.3 The Lead Guest accepts responsibility for all damage or loss caused by any member of the booking party or visitors.

6.4 Guests shall leave the Property in substantially the same condition as found upon arrival.

6.5 The Property must not be used for commercial activities, photo shoots, events, parties, gatherings or functions without the Owner's prior written consent.

7. Maximum Occupancy

7.1 The maximum occupancy stated in the booking confirmation must not be exceeded at any time.

7.2 Only those persons included on the booking may stay overnight.

7.3 Unauthorised overnight guests may result in immediate termination of the booking without refund.

8. Noise and Consideration for Neighbours

8.1 The Property is located within a residential building and Guests must respect neighbouring residents at all times.

8.2 Excessive noise, loud music, shouting, antisocial behaviour or disturbance to neighbouring occupiers is strictly prohibited.

8.3 Particular care must be taken between 10:00pm and 8:00am.

8.4 Any complaint from neighbours, managing agents or local authorities may result in immediate termination of the booking without refund.

9. Strict No Parties Policy

9.1 Parties, celebrations, gatherings, stag parties, hen parties and similar events are strictly prohibited.

9.2 Any breach of this condition shall entitle the Owner to terminate the booking immediately without compensation or refund.

10. No Smoking and Vaping

10.1 Smoking and vaping are strictly prohibited anywhere inside the Property.

10.2 Evidence of smoking or vaping may result in additional cleaning charges.

11. Pets

11.1 No pets are permitted at the Property.

11.2 This restriction forms part of the building's lease and management regulations and cannot be waived.

11.3 Guests must not bring any dog, cat, bird or other animal into the Property without the Owner's prior written consent.

11.4 Any unauthorised pet may result in immediate termination of the booking without refund and the Guest shall be liable for any additional cleaning, damage or costs incurred.

11.5 Nothing in these Terms affects the rights of guests travelling with a registered Assistance Dog where required by applicable law. Guests should notify the Owner prior to arrival.

12. Access to the Property

12.1 The Owner or authorised representatives may access the Property at reasonable times for inspection, maintenance, repairs, emergencies or to investigate breaches of these Terms.

13. Unavailability of Property

13.1 If the Property becomes unavailable due to damage, fire, flood, severe weather, utility failure or circumstances beyond the Owner's control, the Owner may:

  • Offer alternative accommodation where available; or

  • Refund all monies paid.

13.2 No further compensation shall be payable.


14. Cancellations and Amendments

14.1 Cancellation refunds are calculated according to the notice period provided before arrival:

14.2 The booking deposit remains non-refundable.

14.3 Any refund due will normally be paid within 10 working days.

14.4 Booking amendments requested after confirmation may incur an administration charge of £20.

15. Complaints Procedure

15.1 Guests must notify the Owner immediately if any issue arises during their stay.

15.2 The Owner must be given a reasonable opportunity to investigate and resolve any complaint.

15.3 Complaints raised only after departure may not be considered where the Owner was not given the opportunity to rectify matters during the stay.

16. Website Information

16.1 Property descriptions, photographs and information are believed to be accurate but may occasionally contain errors or omissions.

16.2 Furniture, décor and facilities may change from time to time.

16.3 If any specific feature is important to your booking, please verify its availability before confirming your reservation.

17. Privacy

17.1 Guest information will be processed in accordance with the Privacy Policy available on the Website.

17.2 Personal information will only be used for booking administration, guest communications, legal compliance and management of the stay.

18. Liability

18.1 Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence where such exclusion is prohibited by law.

18.2 Subject to Clause 18.1, the Owner's total liability shall not exceed the amount paid for the booking.

19. Governing Law

19.1 These Terms & Conditions are governed by the laws of England and Wales.

19.2 The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from the booking or occupation of the Property.

19.3 The Guest agrees to indemnify the Owner against any losses, damages, costs or expenses arising from any breach of these Terms by any member of their party.
